Hearing continues in APS cheating scandal

ATLANTA -

Defense attorneys want the governor's report on Atlanta Public Schools cheating thrown out. They say educators were threatened to cooperate with investigators or lose their jobs.

The defense has been hammering away at the prosecution's case against 35 educators indicted for cheating on standardized tests. They are trying to get the state report by investigators Mike Bowers and Bob Wilson thrown out because they say educators were forced to cooperate or lose their jobs.

Former DeKalb District Attorney J. Tom Morgan, who is now a defense attorney and represents former Superintendent Beverly Hall, took the stand on Tuesday.

Defense attorney Brian Steel turned his attention to a memo Dr. Hall wrote ordering everyone to cooperate or be fired. Morgan agreed that the memo threatened termination to employees that did not cooperate with investigators.

But during cross examination, the state pointed out that Morgan has changed his spots. Originally, when Morgan was hired by APS, he wrote a memo stating employees could hire attorneys and didn't have to cooperate if they didn't want to.  Now Morgan says he was wrong.

"I made mistakes before. I was wrong," said Morgan.

A ruling is expected in the coming days.
