Father: Sexual assault victim can't get out of apartment lease

ROCHESTER HILLS, Mich. (WJBK) -

A report was made on June 13 about a home invasion and sexual assault at the Woodside Apartments in Rochester Hills.

Sheriff's deputies said a peeping Tom was spotted in the area around the time of the attack and a K-9 unit picked up a track.

George Damian said his daughter, a young, single mother, was the victim. She wants to move out, but the management company will not let her out of her lease.

"They offered to move her to another unit, to an upper floor unit, but she didn't see the guy. So she's still got to go to her car. She's still got to go to the dumpster. So she's going to be scared every time she leaves her apartment. She can't live there," Damian said.

Police released a composite sketch of a suspect. So far there have been no arrests.

We went with Damian to talk to the owner of the management company, but a worker told us he was out of the office.

The alleged victim still owes six months rent at $685 a month, and the company said she is obligated to pay.

Damian said he plans to seek legal help from his electrical workers union and even picket outside the management company's building, if necessary. However, he said he has no plans to pay any more rent.

"We'll be served a notice, I understand, about three weeks after the July payment's not made with a court date, and I'll see what the magistrate says maybe," Damian said.

"There's got to be a thousand units in there. They're not going to lose money. They're going to go in and clean the carpet and paint it like they do every time somebody vacates a rental and rent it again. So I think it's ridiculous that they're showing no compassion whatsoever for my daughter."

The family sent a certified letter and made calls. We also left messages that we not returned.

Damian said his number one concern is his daughter's safety, and he has already moved her furniture out of the apartment.
