Driver, 28, dies in crash trying to elude Duluth police

DULUTH, Ga. -

A fatal crash resulting from a pursuit on Peachtree Industrial Boulevard by Duluth police officers is under investigation. Twenty-eight-year-old Jeremy Kelly, of Flowery Branch, died in the crash last Saturday afternoon.

Accident investigators say Kelly was trying to flee from a Duluth police traffic stop in the area of Shorty Howell Park on Pleasant Hill Road in the City of Duluth for a traffic violation.

Kelly fled from the stop in his black 1995 Nissan Maxima. A Duluth police officer pursued him in a marked patrol car, police said.

Police say Kelly drover recklessly in trying to get away from the Duluth officer, eventually making his way to driving northbound on Peachtree Industrial Boulevard in southbound lanes -- at an extremely high rate of speed.

Forty-nine-year-old Dawn Smith, of Duluth, was driving southbound on Peachtree Industrial Blvd. in her white 2005 Chevrolet Equinox.  Jose Montes, 21, of Norcross, was also traveling southbound in his red 1995 Ford Ranger behind Smith.

Police say Kelly crashed head-on into Smith's vehicle. Montes, Duluth police said, could not stop or avoid the collision and struck Smith's Equinox.

Kelly died at the scene as a result of the injuries he sustained in the crash. Smith and Montes were both transported to Gwinnett Medical Center for treatment of serious, but non-life threatening injuries.

The Gwinnett County Police Accident Investigation Unit continues to investigate this accident. The entire Duluth police pursuit and crash were captured on dash cam video.

The video is not being release at this time as this investigation continues.
