Ex-Orlando officer found not guilty of rape

ORLANDO, Fla. (WOFL FOX 35 ORLANDO) -

An emotional Roderick Johnson shed tears and then hugged his attorney after the former Orlando officer was found not guilty of rape.

"I just essentially said to him that it's over, God was with you, he answered your prayers, we told the truth, and the jury gave us the verdict, the proper verdict," said Robert Nesmith, Johnson's defense attorney.

After the verdict, Johnson embraced family members in the courtroom who stood by him through out the trial. He was accused of raping a woman who he had arrested last year, after prosecutors said he drove her to a police substation. During testimony the woman told the jury that the ex-cop made it clear he wanted to have sex with her so she did, but Johnson repeatedly denied having sex with the woman.

"Any time a young man is accused of rape, it's one of those things of he said, she said, there's no way to prove a negative 'I did not do,'" Nesmith said.

Johnson said little to the media as he walked out of the Orange County Courthouse without taking the stand, his attorney says despite the outcome in his client's favor, he believes he wasn't treated fairly during trial.

"Every person is entitled to fair counsel, and competent counsel, they have an expectation when they come to court, that they'll be treated fairly, I will dare say in this case, that did not occur, but we won anyway," Nesmith said.

Nesmith says he plans on holding a news conference tomorrow to share why he feels his client was treated unfairly
