Luis Toledo enters not guilty plea

SANFORD, Fla. (WOFL FOX 35 ORLANDO) -

Luis Toledo faced a Volusia County Judge Thursday morning on a second-degree murder charge.  He entered a not-guilty plea during the brief court appearance.

Toledo, 31, told investigators that he killed his wife, Yessenia Suarez, 28, in self-defense, but has said he does not know where her body is, or where her two children are.

Suarez's family sat in court as Toledo was escorted into the room, wearing handcuffs. Toledo looked over at the area where Suarez's family was sitting.

Deputies said he killed Suarez after a fight about divorce.  She and her two children have been missing since October 23.  Toledo said someone else killed the children, Thalia Otto, 9, and Michael Otto, 8.

However, Suarez's family believes he is responsible for their deaths and are frustrated he hasn't been charged in their deaths.  FOX 35 News has learned that those charges are expected in the coming weeks.

The family announced earlier this week that they plan to file a wrongful death lawsuit against Toledo.  They said they are doing this to prevent him from making any money off the case, like writing a book.

Toledo is expected back in court in January.
