Taylor father charged in death of infant daughter

Prosecutor Kym L. Worthy has charged Luis Marcos Smolen, 23, of Taylor in connection with the death of his six-week-old daughter, Payton Smolen.

On December 7, 2013, at approximately 9:40 a.m. officers from the Taylor Police Department were dispatched to a home located at 15450 block of Park Village because a baby was reported to not be breathing. The child was transported a local hospital where prosecutors say she had visible head trauma and injuries on her body. She was pronounced dead at the hospital later that day.

Smolen has been charged with First Degree Felony Murder, which can carry a sentence of life in prison without parole, and Child Abuse First Degree, which can carry a sentence of 20 years.

23-year-old Luis Smolen will spend his holidays behind bars. He was charged with first-degree murder Tuesday. The victim, according to Taylor Police, is his six-week-old daughter Payton.

"Wow."

Neighbors like Dominque Carpenter were clearly shocked upon hearing the allegations.

"I don't want to live here no more after hearing that," she says.

"There's no way I can make a child, and love my child, and hurt my child. I couldn't do it. That's just sad," Demetrious Nelson, another Taylor resident, says.

It's all said to have happened over the weekend at the Parks Apartment Complex.
 
Taylor Police responded to a call Saturday morning because the baby wasn't breathing. She was taken to a hospital where she was later pronounced dead. Prosecutors say she had visible head trauma and other bodily injuries.

"It's sad. I just don't understand what's going on in the world right now," says resident Rosolyn Wright.

"He need life," Carpenter says. "You say he needs life in prison?" Wimbley asks. "Yes. Yeah he do, absolutely."

This is not Smolen's first run in with the law. Smolen was free on a ten thousand dollar bond for assault. He was last in court December 4th, days before the alleged attack on his daughter. No word from police on what led up to the child's fatal beating. Taylor residents say no reason he could offer would ever be good enough.

"I don't know what's going on in his brain to do something like that. I don't know if he was on drugs or anything, there's no reason a kid should be hurt," Nelson says.

Luis Smolen is being held in the Wayne County Jail without bond. He'll be back in court Dec. 16.
