A blind marine who spent nearly 2 years in the Seminole County jail is now a free man.
A judge ruled Friday that the March 2012 shooting death of 34-year-old James Dewitt was justified under Florida's "stand your ground" law.
A jury would have started deliberating Friday in the murder case against 40-year-old John Rogers but instead he was released from jail after a judge ruled his case qualified as "stand your ground."
A friend of the victim, Daniel Miller who was there the night of the shooting says he was stunned to find out Rogers is now a free man.
"Self defense I guess he claims, on the other hand you know you can't just take a life like that," Miller said.
Rogers took the stand in his own defense saying Dewitt attacked and threatened him. However some witnesses say the shooting was unprovoked.
