Compromise Leaves Education Issue Unresolved

Posted: Updated:
LOWER MORELAND, Pa. -

Education Activists had seized on the case of Hamlet and Olesia Garcia to make the point that where you live should not determine whether your child can attend a good school, but in the end, a compromise leaves that issue unresolved.

Back in 2012, Montgomery County Prosecutors charged The Garcias with theft of service, a felony for sending their then-5 year old daughter Fiorlla to Pine Road Elementary in the Lower Moreland School District, when the couple actually lived across the border in Philadelphia.

The DA said the couple had cheated Lower Moreland out of more than $10,000 in school taxes.

The Garcias insisted it was a misunderstanding that little Fiorella had lived with her grandfather in the Lower Moreland District while her parents were separated for a time, but with jury selection finally set to begin, both sides compromised.

Under the deal, Hamlet Garcia admitted to illegally enrolling his daughter in the Lower Moreland District. He agrees to pay about $11,000 in school taxes and fines, but avoids a possible felony conviction and jail time.

Charges against Olesia Garcia were dropped altogether. The couple told me back in 2012 that they had always been willing to pay the Lower Moreland School Tax, but that the DA's office had insisted on a criminal prosecution.

Steven Latzer disputed that claim this afternoon. By the way, little Fiorella is now in second grade in a private school in Bucks County.

    NICE EASTER WEEKEND

The first half of the holiday weekend has been great and Easter Sunday looks just as nice. Clouds thin out late tonight with temperatures falling back to the 40s.

Initially it'll be jacket weather early Sunday morning but plenty of sunshine will warm us into the 60s by afternoon.  High temperatures will be a few degrees cooler than Saturday.

It will be noticeably cooler and breezy at the shore with highs in the low 50s.  Quiet conditions continue into Monday.
