(WJBK) -

Craig and Diana Curtice were down on their luck. Their bills were piling up and they were down to their last dollars. Moving from one relative's house to the next, they were depending on their tax refund to get back on their feet.

Diana has four kids, two of whom are disabled. She says one of their disability checks was just recently cut off.

They say they went to Robert Edward, a good friend who has done their taxes for the last few years. But this time they never got their refund money.

Craig says Edward filed their taxes in January pro bono.

Diana said she gave Edward a prepaid debit car with routing number for a place to have the money transferred. But the couple says they soon discovered Edward opened his own account under Diana's name and made himself the authorized user. They claim he pocketed their federal tax return of $8,566.

Edward, who they claim made one excuse after another, may look familiar.

He is the father of Kathleen, the 7-year-old girl from Lincoln Park who suffered from Huntington's Disease. The dying girl was bullied and taunted by her adult neighbor, Jennifer Petkov. The story drew international attention before the young girl died in 2012.

In fact, those are the circumstances on how the Curtices and Edwards met and became close. Craig says he wrote a song for Edward's dying daughter.

After they realized the refund money was missing, they immediately contacted the IRS and Secret Service and FOX 2's Taryn Asher was told the U.S. Attorney's Office is investigating.

Edward returned Asher's phone call late Thursday afternoon.

He confirmed to her he is being investigated, and he did file an illegal tax return for the Curtices. But, he claims he did not take all of the money. He says there's more to the story but would not elaborate.
