Mother of third-grader files suit against school bully, principal

MOUNT PROSPECT, Ill. (Sun-Times Media Wire) - The mother of a student at a northwest suburban elementary school has filed a lawsuit against a fellow student who allegedly bullied her son and threatened his life over a period of months.

The student, Joaquin Del Core, and his mother, Deveri Del Core, claim he was bullied by a fellow third-grader at least once a week while enrolled at Robert Frost Elementary School at 1805 Aspen Dr. in Mount Prospect.

The suit states the other student hit, punched, choked, kicked and spat on Joaquin, even threatening to kill him throughout the 2013-14 school year.

The suit, filed Tuesday in Cook County Circuit Court, names the student and his parents, School District No. 21, and Robert Frost Principal Jeffrey Brusso as defendants.

Deveri Del Core alleges she reported incidents of assault and battery to Brusso, but the principal and school district “consciously disregarded” their duty of protecting her son, according to the suit.

Joel Handler, the plaintiff’s attorney, said Joaquin’s parents filed at least four police reports as a result of the alleged assaults. Handler said they did not result in any disciplinary action against the student.

As a result of the bullying, Joaquin was “seriously and permanently injured,” the suit states.

The three-count suit claims failure to provide adequate security by the school district and Russo, assault and battery by the student, and willful and wanton misconduct by the student’s parents.

“As a district, and at each of our schools, we value the safety and security of each and every one of our students and staff members, and take bullying prevention very seriously,” a statement from School District 21 Supt. Kate Hyland said.

“We work diligently to provide a healthy, productive environment for all of our students to learn and grow,” she said.
